WHAT THE COPS WON'T TELL YOU

COPS ARE SUSPICIOUS.

Cops are taught to be suspicious. They are afraid someone is going to kill them. That's why they wear bullet-proof vests. They believe that everyone is guilty of something. It's their job to find out what you are guilty of. That's why they ask you questions. They want to know where you have been and what you have been up to. And while they are asking you, they are sniffing the air to see if they can smell any marihuana or alcohol, which gives them the right to search your person and your entire car.

DON'T ANSWER QUESTIONS.

No one is required to answer any questions from a cop. Instead say, "I DON'T ANSWER QUESTIONS. I WANT A LAWYER." When you say you want a lawyer, the cops have to stop questioning you.

Cop: Where are you going?

You: I don't answer questions. I want a lawyer.

Cop: How much have you had to drink?

You: I don't answer questions. I want a lawyer.

Cop: Do you have anything you are not supposed to have?

You: I don't answer questions. I want a lawyer.

If you get a phone call from a cop wanting you to come in and give a statement, DON'T DO IT. IT'S TIME TO LAWYER UP. Never talk to a cop without a lawyer. No exceptions.

NEVER ADMIT ANYTHING.

You have the right to remain silent. Use it. Don't lie. Just don't answer. Anything you say can and will be used against you. This is true with probation officers and wives also. Don't lie, just don't answer. An admission is a confession which will convict you.

BEING COOPERATIVE GETS YOU NOWHERE.

The cop will tell you that If you cooperate, things will go better for you. They won't. If you think the cop will let you go if you cooperate, you are being foolish. If the cop smells marihuana or alcohol, you are going to jail. If you have been in a wreck and the cop smells alcohol, you are going to jail. Don't ruin your case. Give your lawyer something to work with. Cops are taught to lie to citizens in order to get them to confess. Don't believe a word they say.

NEVER CONSENT TO A SEARCH OF YOUR PERSON, YOUR POCKETS, YOUR CAR, YOUR HOME, OR YOUR CELL PHONE.

Make the cop get a warrant. If you consent to a search, you have thrown away all your Fourth Amendment rights.

NEVER TAKE THE STANDARD FIELD SOBRIETY TESTS.

Field sobriety tests are designed by cops to make you fail. Don't take any of them. Just say, "No thanks."

No law requires a person to submit to a field sobriety test. The cops won't tell you this.

You are being judged by a cop who wants you to fail so he can take you to jail. There are three tests commonly in use in Texas.

  1) Making you look at a pencil or a light in front of your eyes. This is called Horizontal Gaze Nystagmus. The cop is looking to see if your eyes jerk. Don't look at the pencil. Just say, "No Thanks. I don't take tests."

  2) 9 Step Walk and Turn. The cop overloads you with instructions you couldn't possibly follow while you are standing in an unnatural heel to toe position. Don't do it. Nobody can pass this test. Just say, "No Thanks. I don't take tests."

  3) Flamingo test or stand on one foot and raise the other while counting test. Only Flamingos can stand on one leg. Don't take this test. You'll fail. Just say, "No Thanks. I don't take tests."

DON'T BLOW OR GIVE BLOOD

Never blow into a Breathalizer if you have had ANYTHING to drink. You will fail. You may have your driver's license suspended but you can get an occupational drivers license from your friendly justice of the peace.

Never give blood unless the cop has a search warrant.

DON'T DO ANYTHING THE COP WANTS YOU TO DO. DON'T TALK. DON'T CONSENT. DON'T TAKE TESTS. DON'T BLOW OR GIVE BLOOD.

The right to a trial by jury is the most powerful weapon you have.

The Court system is not designed for jury trials. There are many cases and only a few judges. The court system is designed for surrender - yours.

DON'T GET A COURT APPOINTED LAWYER IF YOU CAN HELP IT.

Court appointed attorneys get paid when the case is over. When you plead guilty they get paid. They have a conflict of interest with you. Hire your own lawyer.

DON'T TALK TO THE PROSECUTOR.

Never talk to the DA without a lawyer. The DA will offer you a conviction or a probation. The DA will not tell you what is wrong with his case against you. He will not dismiss your case. He will not give you an evaluation of your case. He will not give you a copy of the police report. He wants and need a plea of guilty. The DA wants you to waive (give up) a jury so you can start paying the DA's salary.
